Living Will In Texas

  • A common type of will is called a living will, or referred to as a Directive to Physicians.  You should have one because you may need one if you are unconscious, mentally incapacitated, or are otherwise unable to tell the doctors what you want.  You would want to have one if you are a resident of a nursing home or are going into the hospital for surgery
  • It is different than a medical power of attorney because a medical power of attorney authorizes a person to make medical decisions on your behalf if you become incapacitated or otherwise unable to make those decisions on your own.  A living will deals with life support issues should your condition be terminal.  It allows you to express your wishes regarding any life-sustaining treatment in the event that you become terminally ill due to illness, injury or disease
  • It allows you to express your wishes regarding treatment, and it relieves family members from having to make difficult decisions at such an emotional time
